Program Description:
In commercial litigation, parties often focus the vast majority of their efforts on liability issues and mistakenly defer their damages analysis until late in the litigation. Damages, however, are often the most significant factor in determining the outcome of commercial cases. The panel will present an overview of damages and other remedies available in commercial litigation. The topics discussed will include contract damages and other remedies, statutory damages, punitive damages, and limitations on damages. Financial experts will present on the methodologies and challenges in calculating and proving damages.
